Terms of Use Statement

Introduction. This Agreement explains our obligation to you, your obligation to us, in relation to the use of any Gallo World Family Foundation service, including, but not limited to, those outlined in websites controlled by the Gallo World Family Foundation. Amendment. The Gallo World Family Foundation may modify this agreement at any time in its sole discretion. Modifications may be posted on any Gallo World Family Foundation website, including those controlled by Gallo World Family Foundation, or by e-mail message, or conventional mail. Use of Service. You may only use the Gallo World Family Foundation services on our terms. The Gallo World Family Foundation may immediately, at its sole discretion, terminate service to violating users. Charges. You are responsible for all published fees and charges, if any, associated with the use of any Gallo World Family Foundation services. Termination. This agreement became effective December 29, 2002, and remains in effect until terminated by the Gallo World Family Foundation. Limitation Of Liability. Under no circumstances, including negligence, will the Gallo World Family Foundation, or any affiliated company or person, be liable to you for any direct, indirect, incidental, special or consequential damages that result from your use or inability to use any Gallo World Family Foundation service, including but not limited to reliance on any information provided by them; or that result from mistakes, ommissions, interruptions, deletion of files or e-mail, loss of or damage to data, errors, defects, viruses, spam or junk mail, delays in operation or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to the Gallo World Family Foundation information records, programs or services. The terms of this Section shall survive any termination of this agreement. Right Of Refusal. Although we may assign you a Gallo World Family Foundation e-mail address of your choice if you become a Gallo World Family Foundation, the Gallo World Family Foundation reserves the right to refuse your selection and you agree that such refusal is not a basis for liability or damages to you Severability. You agree that the terms of this agreement are severable. If any term or provision is declared unenforcable, that term of provision will be construed consistant with applicable law as nearly as possible to reflect the original intent between us, and the remaining terms and provisions remain in full force and effect. Acceptable Use. All Gallo World Family Foundation services are a family type service meeting community standards norm. Notices. Notices to the Gallo World Family Foundation may be sent by email to mail@gfusa.net, otherwise to Gallo World Family Foundation, 4050 N. Maiden Drive, Baton Rouge, Louisiana 70809. Failure To Perform. The Gallo World Family Foundation has obtained, leased, rented, or purchased, Internet server capacity in the open market and will not be liable for failure to perform any obligation under this agreement, including, but not limited by, failure caused by the occurrence of any unforseen contingency beyond the reasonable control of a Gallo World Family Foundation service and/or its "server" including without limitation outages, communications outages, fire, flood, war, or act of God whether to the Gallo World Family Foundation facility or the "server" facility. General Terms. Interpretation and enforcement of this agreement will be governed by the laws of the state of Louisiana, United States of America.  Gallo World Family Foundation 2009
